Privacy Policy - myAudi Portal and Audi ID

A. Scope of the privacy policy

In this Privacy Policy, we are informing you about the processing of your personal data by AUDI AG, Ettinger Straße 70, 85057 Ingolstadt, Deutschland / Germany ("We", or “Audi”) in connection with the myAudi portal and the Audi ID.

Audi manufactures vehicles that communicate in certain countries with the Audi IT system or over the Internet with servers of service providers by means of a cellular communication unit (pre-installed or provided by the user). Subject to availability, Audi provides information and control services for your vehicle on the IT system (" Audi connect Services"). Please note that not all Services may be available for your vehicle or in your country.

The myAudi App and the myAudi Portal are parts of the myAudi system world (hereinafter “myAudi”), which allows you to use personalized Audi connect Services and other applications by Audi (hereinafter “Services”) related to your vehicle. Separate privacy notes may apply to the use of Audi Connect Services in the vehicle as well as to other websites beyond the myAudi Portal or other data processing of Audi (e.g. www.audi.com/connect).

Personal data means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Processing means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

B. General Information

I. Who is the controller for the processing?

The controller for the processing activities within the meaning of Art. 4(7) GDPR - as described below in section C - is the AUDI AG, Ettinger Straße 70, 85057 Ingolstadt, Deutschland / Germany . With regards to particular processing activities, Audi is a joint controller together with the respective operator of a myAudiShop (see list of importers in Annex A, hereinafter “Shop Operator”), or with the Volkswagen Payments S.A. (19-21, Route d’Arlon, Bloc D, L-8009 Strassen, Luxembourg (hereinafter “ Electronic Money Institution (EMI)”), acting as a payment service provider. Information on whether Audi is the only controller or a joint controller together with the Shop Operator or EMI for a specific processing activity can be found in section D. IV. Which rights do I have?

Depending on your jurisdiction, as the data subject, you may be entitled to the following data protection rights::

1. Access

You have the right to obtain information on the data stored concerning you at Audi and the scope of data processing and data transfer performed by Audi, and to obtain a copy of the personal data stored concerning you.

2. Rectification

You have the right to obtain without undue delay the rectification of inaccurate personal data concerning you as well as the completion of incomplete personal data stored concerning you at Audi.

3. Erasure

You have the right to obtain the erasure of the personal data concerning you stored at Audi without undue delay if the statutory requirements are met.

This may be the case, in particular, if

  • Your personal data are no longer necessary in relation to the purposes for which they were collected;
  • The sole legal ground for the processing was your consent and you have withdrawn it;
  • You have objected to the processing based on the legal ground of a balancing of interests on grounds relating to your particular situation and We cannot prove that there are overriding legitimate grounds for the processing;
  • Your personal data have been unlawfully processed; or
  • Your personal data have to be erased for compliance with a legal obligation.

If We have shared your data with third parties, We will inform them about the erasure, insofar as required by law.

Please note that your right to erasure is subject to restrictions. For example, We are no required or allowed to delete data that We are still obligated to retain due to statutory retention periods. Similarly, data that We need for the establishment, exercise or defence of legal claims are excluded from your right of erasure.

4. Restriction of processing

You have the right to obtain, under certain conditions, restriction of processing (i.e. the marking of stored personal data in order to restrict their future processing). The requirements are:

  • The accuracy of your personal data is contested and Audi must verify the accuracy of your personal data;
  • The processing is unlawful, but you oppose the erasure of the personal data and instead request the restriction of the use of the personal data;
  • Audi no longer needs your personal data for the purposes of processing, but you require the data for the establishment, exercise or defence of legal claims.
  • You have objected to the processing and the verification is pending whether the legitimate grounds of Audi override yours.

In the event of a restriction of the processing, such data will be marked accordingly and will be – except for their storage – only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.

5. Data portability

To the extent that We automatically process your personal data provided to us based on your consent or a contract with you (including your employment contract), you have the right to receive the data in a structured, commonly used and machine-readable format and to transfer those data to another controller without hindrance from Audi. You also have the right to have the personal data transferred directly from Audi to another controller where technically feasible and provided that this does not adversely affect the rights and freedoms of others.

6. Objection

If We process your personal data on the basis of legitimate interests or in the public interest, you have the right to object to the processing of your personal data on grounds relating to your particular situation. In addition, you have an unrestricted right to object if We process your data for our direct marketing purposes. Please see our separate note in the "Information on your right to object" section.

In certain cases, We also grant you, beyond the privacy settings, an additional unlimited right to object within the scope of the balancing of interests. We will inform you about this in connection with the respective feature or Service.

7. Withdrawal of consent

If you have given consent to the processing of your personal data, you may withdraw it at any time. Please note that the withdrawal shall only be effective for the future. Processing that occurred before the withdrawal shall not be affected.

8. Complaint

In addition, you have the right to lodge a complaint with a data protection supervisory authority if you believe that the processing of your personal data is unlawful. 9. Information on your right to object

a) Right to object on grounds relating to your particular situation

You have the right to object to the processing of your personal data on grounds relating to your particular situation. The prerequisite for this is that the data processing takes place in the public interest or on the basis of a balancing of interests. This also applies for any profiling. Insofar as We base the processing of your personal data on a balancing of interests, We generally assume that compelling legitimate grounds can be demonstrated, but We will, of course, examine each individual case. In the event of an objection, We will no longer process your personal data.

Unless,

  • We can demonstrate compelling legitimate grounds for the processing of such data which override your interests, rights and freedoms or
  • Your personal data are used for the establishment, exercise or defence of legal claims.

b) Objection to the processing of your data for our direct marketing purposes

Where We process your personal data for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing; this also applies to profiling to the extent that it is related to such direct marketing. If you object to the processing for direct marketing purposes, We will no longer process your personal data for such purposes.

c) Objection to the processing of your data for product improvement and general customer analysis

As part of the balancing of interests, We grant you a separate right of objection with regard to the processing of your personal data for product improvement and general customer analysis.

If you object to the processing for the purpose of product improvement and/or general customer analysis, We will no longer process your personal data for these purposes. Purely statistical evaluations of aggregated or otherwise anonymous data remain unaffected by this.

d) Exercise of the right to object

The objection can be exercised in any form and should preferably be addressed to the contact details listed in section A. II.

V. Which data do We process for which purposes and which legal bases apply?

We process your personal data in myAudi in accordance with the provisions of the General Data Protection Regulation (“GDPR”) and the German Federal Data Protection Act (Bundesdatenschutzgesetz, “ BDSG”) and other local law for various purposes. The specific data and purposes of data processing are primarily based on the myAudi features Services used. Please note that not all listed myAudi services may be available in your country. In addition, We may process your personal data based on the following legal grounds for the following purposes:

We have a legitimate interest in carrying out evaluations for the management of our business processes and cost control on the basis of the analysis of sales and order data according to the model sales channel, order status, analysis of requested versions and equipment, reporting on business indicators, if necessary by using the vehicle identification number.

Enforcement of legal claims and defence in legal disputes

We have a legitimate interest in the establishment, exercise or defence of legal claims.

Insofar as We process further data for other purposes or based on another legal basis, We will state this separately with the respective legal basis in the notes in sections C and D.

VI. Who receives my data?

Within Audi, those entities receive your data that they need to fulfil our contractual and statutory obligations and to safeguard our legitimate interests. Our service providers (so-called processors) that We utilise and engage may also receive data for these purposes. We will generally share your personal data with third parties only if this is necessary for the performance of the contract, if We or the third party have a legitimate interest in the disclosure, or if you have given your consent. In addition, data may be shared with third parties (including investigative or security authorities) to the extent We should be required to do so by law or by enforceable regulatory or judicial orders. Details of the processors We use and the other recipients who receive personal data are included in the following section B. VI. 1. . Due to the size and complexity of data processing by Audi, it is not possible to list each recipient of your personal data individually in this privacy policy, which is why generally only categories of recipients are specified.

1. Processors

Service providers which are used and act on behalf of Audi (so called processors) may receive data for the following purposes. We utilise processors of the following categories for the provision of specific services, who support us in the execution of our business processes. Specifically, this includes undertakings in the following categories:

· Tracking service providers (see “Cookies and user tracking”)

· Web agencies

· Hosting providers

2. Third parties

Third parties may receive data for the purposes set out in section A. V.

If We share your data with additional processors or third parties within the framework of individual Services, We will inform you in the Service starting in sections C. I. and II. or in section B. VI. 3.

3. Is data transferred to a third country?

A transfer of data to third countries (i.e. countries that are neither members of the European Union nor of the European Economic Area) may take place, to the extent this is required for the provision of Services to you, is required by law, or you have given us your consent. In addition, We may also share your personal data with processors in third countries.

Please note that not all third countries have a level of data protection recognised as adequate by the European Commission. For data transfers to third countries where there is no adequate level of data protection, We ensure that, prior to disclosure, the recipient has either an adequate level of data protection (e.g. adequacy decision of the EU Commission or agreement of so-called EU Standard Contractual Clauses of the European Union with the recipient) , or We have obtained express consent from our users.

You can obtain a copy from us of the specific applicable or agreed rules to ensure the adequate level of data protection. Please use the information in the Contact section for this purpose.

Details of data transfers to third countries, where relevant, are given in this section or in section C. with regards to individual Services.

VII. How long will my data be stored?

We store your data as long as it is necessary for the provision of our services to you or We have a legitimate interest in the further storage, in particular for reasons of troubleshooting.

In addition, We are subject to various retention and documentation obligations, which result, inter alia, from the German Commercial Code ( Handelsgesetzbuch, “HGB”) and the German Tax Code (Abgabenordnung, “AO”). The periods specified therefore for retention and documentation are up to ten years. Finally, the storage period is also assessed according to the statutory limitation periods, which can be up to thirty years, for example, according to Sections 195 et seqq. of the German Civil Code ( Bürgerliches Gesetzbuch, “BGB”), with the regular period of limitation being three years.

Under certain circumstances, your data may also need to be retained for a longer period of time, such as when a so-called legal hold or litigation hold (i.e. a prohibition of data deletion for the duration of the proceedings) is ordered in connection with administrative or judicial proceedings.

To the extent further details are possible, you will find further information on retention obligations in section C with regards to individual Services.

C. Processing for which Audi is the only controller

I. Services in myAudi

1. Access to the website

In principle, you can access the website https://my.audi.com/ (" Website") without providing any personal data. However, the use of certain Services requires registration on the myAudi portal or myAudi app and the provision of personal data. In addition, We process your personal data if you contact us via the Website. Information on the processing of personal data in connection with your Audi ID can be found in section C. I. 2 and in connection with the myAudi portal in section C. I. 3. Each time you use the Website, your internet browser automatically transfers certain information which We store in so-called log files. In particular, the following information is transferred automatically:

· IP address (Internet protocol address) of the device from which the online offering is accessed;

· Internet address of the website from which the online offering was accessed (so-called origin or referrer URL);

· Name of the service provider via which the online offering is accessed;

· name of the files or information retrieved;

· date, time, and duration of retrieval;

· volume of data transferred;

· Operating system and information on the Internet browser used, including installed add-ons (e.g. for the Flash Player);

· http status code (e.g. "request successful" or "requested file not found").

In the log files, the above data is stored without your complete IP address, so that no attribution to your IP address is possible.

We process your personal data for the access of and use of the Website on the basis of the following legal bases and for the following purposes:

Sending product and service information

Special features in the myAudi Portal and Audi connect Services:

A registration of an Audi ID by providing your e-mail address, password and other personal data (such as contact details) is required for the access to specific Services in the myAudi Portal and the myAudi App. The use of Services in the myAudi Portal and the myAudi App is only possible after a successful log-in with the Audi ID. We process the personal data which you provide during the registration, respectively during the use of the features and Audi connect Services in the myAudi Portal. Further information on the processing of your personal data in connection with individual Services can be found in section C. I. 3.

We process your personal data in connection with the Services in myAudi and the Audi connect Services for the provision of different Services and features for logged-in users, e.g. provision of contents or Audi connect Services, always on the legal basis of a performance of a contract according to Art. 6(1)(b) GDPR, unless stated otherwise in the following sections and in section C. II.

In addition to section B. VII. the log files with personal data are stored by us for the investigation of malfunctions and for security reasons (e.g. for investigating attack attempts) for 7 days, and then deleted. Log files whose further retention is required for evidentiary purposes are exempt from deletion until the final clarification of the respective incident.

2. Audi ID

With the creation of an Audi ID account you automatically have access to the myAudi system world. The Audi ID is also a single-sign-on (“ SSO”) solution for the Services of Audi and third parties outside of the myAudi system world (hereinafter collectively called “ Services”). This means that you can access a variety of Services in the digital world of Audi with only one account.

a) Audi ID account and myAudi

In order to access the portal, you only need to provide the personal data that is required for the creation of the Audi ID. This includes the following mandatory data fields: username (your e-mail address), password, salutation, surname, given name, country and language. Without this data, We will have to refuse access to the myAudi system world, or We will possibly have to terminate an existing agreement.

All other information for the completion of your profile is voluntary and not required for the creation of the Audi ID and to access to the myAudi system world. This information is only stored for the future use of additional myAudi applications, Audi connect Services or other Services. The optional data includes: address, phone number, place of birth, date of birth, nickname, profile picture, academic degree/title, invoice address and nationality.

You can change or adjust all data at any time under “Account” and then under “Account settings” (myAudi Portal) or under “Settings” and then under “Account settings” (myAudi App). The exception to this is the user name and the country/language combination of the registration .

We process your personal data in the course of the registration and creation of the profile of the Audi ID on the following legal basis: performance of a contract or performance of pre-contractual measures, where this is necessary (Art. 6(1)(b) GDPR). The processing is for the purpose of providing a SSO solution for myAudi and other Services (see the following section C. I. 2. b)).

We use the following processors for the Audi ID:

· Volkswagen AG, Berliner Ring 2, 38440 Wolfsburg for the operation and hosting of Audi ID.

· Amazon Web Services Ireland Limited, One Burlington Plaza, Burlington Road, Dublin 4, Ireland for the storage of data. The storage takes place on cloud servers in Ireland.

b) Use of the Audi ID for other Services (SSO solution)

At your request, Services can be linked with the central Audi ID and the personal data you have provided in this context will be shared with the respective Service. It is required that the Service offers log-in via Audi ID. If this is the case, you do not need to re-register, but can use the data provided during the initial registration and, if applicable, the optional data provided during the administration of your profile.

In order to use the Audi ID for the Services of third parties, you need to confirm a so called access authorisation prior to the use of the respective Service of a third party. The access authorisation form states which data fields the Service of a third party needs to access. The type and extent of personal data that needs to be transferred to a Service of a third party is based on what is necessary for the performance of the Service. Mandatory data fields are marked as such in the access authorisation form. We transfer the data for the performance of a contract (Art. 6(1)(b) GDPR) between you and the third party for the purpose of providing the Service. Any access authorisation can be viewed on the account page under “Connected applications” and be adjusted (e.g. withdrawn) by you.

Depending on the access authorisation, We transfer data to the following providers of connected Services:

· Audi France Portal (AUDI France, 11 avenue de Boursonne, 02601 Villers Cotterêts, France)

· Audi Shopping World (Audi Sport GmbH, NSU-Straße 24 – 32, 74172 Neckarsulm and Auto Union GmbH, Auto Union Str. 1, 85045 Ingolstadt, Deutschland / Germany

· Volkswagen Group España Distribución S.A.U. Parque de Negocios Mas Blau II, Edificio Landscape – C/de la Selva 22, 08820 El Prat de Llobregat (Barcelona), Spain)

We store changes and adjustments to the data which you make when using Services in the Audi ID and also forward such changes and adjustments to Services linked in the Audi ID. This allows for a central data administration via the Audi ID. If a Service requires data which you have not yet entered in the course of the optional data input for the Audi ID, this information is additionally requested for the first time directly at the beginning of the Service.

3. Account settings

We process nickname, forename, surname, date of birth, e-mail address, address and phone number (country-specific optional) within the myAudi Portal and myAudi App. This is required to use certain applications and Audi connect Services in your vehicle. You may assign a vehicle in the myAudi Portal and myAudi App by entering and storing your vehicle identification number.

4. Primary user verification

In connection with your primary user verification of your Audi and the conclusion of the primary user contract We will process name, personal or professional contact details (email, address, telephone number), date of birth during the verification of the primary user and the conclusion of the primary user contract. Provided that you select mobile phone for verification of the primary user, Audimay will, in compliance with statutory requirements, call the telephone number provided for the purpose of verifying your identity or send you text messages (SMS) . We will send you an e-mail if you chose the verification by e-mail. Provided you select an Audi partner for verification, We will transfer your data to the Audi partner you have selected for the performance of the verification.

5. My vehicles/vehicle information

Enter your vehicle identification number to create your vehicle in the myAudi app or on the myAudi portal and display the equipment features of your vehicle. When you do this, the myAudi app or the myAudi portal sends the vehicle identification number that you have entered to us to retrieve the relevant details of your equipment from our IT systems. This data is required in order to use certain applications and Audi connect services in your vehicle or to use “My vehicles” in the myAudi app or on the myAudi portal. You can also edit personal vehicle details in the "My vehicles" section. For example: Create a custom vehicle name, enter your mileage, view vehicle registration number, first registration and purchase price. To add a vehicle in the myAudi app and on the myAudi portal, enter and save your vehicle identification number. When using "My vehicles", the technical equipment details of your vehicle and the vehicle details you can edit and customize are linked to your Audi ID and saved when you enter your vehicle identification number or your order number and your activation code.

6. Fleet vehicle

This function on the myAudi portal shows you whether a vehicle is part of a fleet. We process the following data and categories of data for this purpose: Vehicle identification number (VIN) of your vehicle. The VIN is shared with the fleet manager, if the vehicle is part of a fleet.

7. Saved configurations

You can save vehicle configurations in the myAudi portal. We process the following data or data categories for this purpose: vehicle configuration.

8. Service request/booking

As part of the service request/booking process, you can request and book service appointments with your selected Audi service partner. When you send your request and/or make your booking, we process the following data and data categories that you have provided in the request/booking: Service appointment booking: Name, contact details (address, e-mail address, mobile phone number), vehicle registration number, approximate mileage and the vehicle identification number of your vehicle.

We process the data to carry out the specific request/booking and for further use on your behalf on the myAudi portal and in the myAudi app for future requests and/or bookings. We transfer the data to your selected Audi service partner to arrange and carry out the appointment.

When your data is processed for the service request, your information may be accessed from the USA for the purposes of technical support. We have therefore concluded EU standard contractual clauses or SCCs (a set of contractual clauses approved by the European Commission that gives personal data the same protection as it has in the EU when data is processed in non-EU countries).

You can delete or change the data at any time on the myAudi portal and in the myAudi app. We store the data until you delete or change it or delete your Audi ID.

9. Digital service plan

This feature allows you to view and retrieve the service plan for your vehicle in the myAudi portal or myAudi app. We process the following data or data categories for this purpose: vehicle identification number of your vehicle, information on service measures carried out. You can view and retrieve this data in the myAudi Portal or myAudi App. We save this data in the myAudi system world until you delete it in the myAudi Portal or myAudi App or unlink the assignment to the vehicle, or delete the Audi ID. Please note that We do not delete the data completely, but the assignment to your Audi ID is merely cancelled. The data is still stored together with the associated vehicle identification number in order to provide this feature to you.

10. My Audi partner

At your request, the dealer can support features and Services regarding the myAudi system world (e.g. creation of the Audi ID, primary user verification). The dealer will be listed as an Audi partner in the myAudi system world during the registration and thereby gains access to the personal data provided by you via a system interface (see section C. I. 2, “Audi ID”. This data may be at all times changed or adjusted after registration). It is an essential requirement for the registration process and the listing as an Audi partner that you have given your instruction to the Audi partner. Without this, a registration via the partner is not allowed. To conclude the registration process, you also need to confirm a link sent to you via e-mail after the Audi partner has created the Audi ID according to your instruction.

It is also possible that you search for a specific Audi partner via the myAudi partner search in the myAudi Portal or myAudi App and save the desired Audi partner, if you already created an Audi ID. We will then link and store your Audi ID to the Audi ID of the Audi partner at Audi. If you link your account to a specific Audi partner, you give your consent that the Audi partner may access your profile data for support and service purposes. Additionally, you can book appointments at your Audi partner online. Please note that not all features may be available in your country.

It is possible at any time to save, substitute or delete the Audi partner.

11. Customer folder

In the context of individual customer support by your Audi partner, We process your contact details (name, address, e-mail address, mobile phone number), data related to your stored configurations and additional data relating to your registered vehicles (vehicle identification number, model name, connect status, primary user status, contract number). In case you gave your corresponding consent, We show this data to your Audi partner that you have contacted or whose services you have used, or for consultations or provision of services.

12. Data packages

If you want to book data packages for your vehicle, you can be forwarded via this Website to the website of the provider Cubic Telecom. If you consent, We will share your personal data with Cubic Telecom (for Wi-Fi data packages), so that you do not need to re-enter your information when making your booking.

13. Original Audi accessory

You can be forwarded to the Audi Shopping World in the myAudi portal. For this, you need to use the corresponding link under “Audi original accessory”. Vehicle and profile information is transferred thereby. If you place an order in the Audi Shopping World, this data is used as basic information there. You can adjust your data of the Audi ID at any time in the Audi Shopping World, e.g. by stating a different delivery address. This delivery address will not be transmitted back and stored in the Audi ID.

14. Individual upgrades

You can inform yourself about product upgrades fitting for your vehicle at your chosen Audi service partner in the context of individual upgrades. For this We process your contact details: name, contact details (e-mail address, mobile phone number), license plate, approximate mileage and vehicle identification number of your vehicle. We process this data for the specific consultation. We transfer this data to your chosen Audi service partner for the consultation.

15. Engine oil

You can use the standard oil function to find out what engine oil is recommended for your vehicle. We process the vehicle identification number of your vehicle for this purpose.

16. Audi Digital Twin / digitaltwin.audi

The prior registration in the myAudi Portal or myAudi app, respectively the creation of an Audi ID and primary user verification is required for the use of this Service. By clicking on this Service in the myAudi Portal, the vehicle identification number (with which your vehicle can be clearly identified and assigned to a specific owner) is transferred to the Audi Digital Twin page. You are automatically signed up on the Audi Digital Twin page with your Audi ID. This Service helps you create a “digital twin” to facilitate the sale of your vehicle. It is a digital processing of all information related to your vehicle. The following data or data categories of your vehicle are processed within the framework of this Service (both at the Volkswagen AG and Audi): With your vehicle identification number (with which your vehicle can be clearly identified and assigned to a specific owner) essential information related to your vehicle (vehicle type, performance etc.) and vehicle equipment details (seat heating etc.) will be retrieved at the point of transmission to the information systems of Audi. With this data, Audi creates the Audi Digital Twin, which can be downloaded as a PDF file and shared via the button <Share>. 18. Additional data

We process data that you provide to your Audi partner if the Audi partner creates your Audi ID and therefore sets up the use of the myAudi portal and myAudi app. You only need to provide the data required for the registration or primary user verification and, if necessary, data required for other features used by you. Please see section (TBD) regarding the required information.

We also process data from your vehicle for specific Services. Details of the relevant Services can be found in the specific information starting in section C. II. or in the sections above.

Information on data processing in connection with the use of cookies and user tracking as well as data processing in connection with specific features can be found in the Cookie Policy of myAudi at my.audi.com/cookie-policy.

II. Audi connect Services

1. General information

The use of personalised Audi Connect Services requires the registration of an Audi ID in the myAudi portal or myAudi app. In order to provide personalised services in your vehicle, Audi transfers the Audi ID data (e-mail and password token) to your vehicle. The Services available for your vehicle and license durations are assigned to your Audi ID and saved to myAudi system world. You can specify a preferred notification channel (e.g. email address) for application notification features, e.g. information on your vehicle’s climate and charge status (in the case of Audi e-tron vehicles). Your vehicle also transfers certain data to the Audi back end for some Audi connect Services (as described in the Audi connect Service below) so that you can view and retrieve it in the myAudi portal or myAudi app.

Your vehicle transfers specific data to our IT systems or the IT systems of our service providers. On this basis of the data transferred from your vehicle, We provide to you a Service or content, which We deliver directly from our IT systems or the IT systems of our service providers to your vehicle or the app. This always requires at least a technical assignment of an query to a Service to a vehicle. This assignment is made either via the vehicle identification number of your vehicle or a pseudonym.

2. Specific Audi connect Services

a) Privacy settings

You have the option of making certain privacy settings in your vehicle menu and deactivating the transmission of different data categories or deactivating individual Audi connect Services. Your current setting can be accessed by authorised users of the vehicle in the myAudi portal or via the myAudi app. As part of the Service, We process the following data or categories of data from your vehicle: vehicle identification number (with which your vehicle can be uniquely identified and assigned to a specific owner), the chosen privacy setting. We process the above data to enable you and authorised users to view the privacy settings in the myAudi portal or in the myAudi app.

b) Map update

With this Audi connect Service the navigation database can be updated online directly in the vehicle . The vehicle analyses which regions within a country (e.g. Bavaria) are relevant for the vehicle and transfers this information directly to the IT systems of Audi. If the customer agrees to this, the map update will then be rolled out and downloaded in the vehicle via the IT systems of Audi. With the roll-out, all information will be deleted in our IT systems. We may use a service provider for the provision of the maps, HERE Global B.V., Kenedyplein 222, 5611 ZT Eindhoven, Netherlands. The service provider will not receive any vehicle-related or personal data.

c) Audi connect key

The Audi connect Service “Audi connect key” is a personalised and safety-relevant Service. It allows the user to unlock, start and lock the vehicle. The use of the Service requires the previous registration of an Audi ID and the verification as the primary user in the in the myAudi app or myAudi portal. . Furthermore, the use of the Audi connect key requires the download of the myAudi app.

For the proper assignment of the Audi connect key to a user's mobile device, this device transfers the following personal data to the IT systems of Audi for the purposes of authentication and authorisation: , ICCID, device type, app version and OS version and Google Cloud Messaging/Firebased Cloud Messaging Token. This data is stored in the IT systems of Audi together with the vehicle identification number (with which your vehicle can be uniquely identified and assigned to a specific owner) and the assigned Audi connect key for the purpose of authentication and verification of authorisation until the assignment of the terminal device is unlinked. This is required for the device to be recognised as an authorised key. Audi uses processors as hosting and support service providers for the provision of the Service. When assigning a key to a user, you can allow the app to access the address book and select users there.

With the assignment of an Audi connect key to a user, the respective vehicle is also linked to the user and the user can see the vehicle and the vehicle equipment in the myAudi portal or myAudi app. The primary user can see which users (email address) with which key name (which the primary user himself or herself has assigned) are assigned to the vehicle.

When using the Audi connect key, i.e. when unlocking, starting and locking the vehicle using the mobile terminal, data is transferred from the mobile terminal to the vehicle by means of Near Field Communication (NFC). This data is not transferred to Audi.

In addition, when using the Audi connect key, the following data are transferred to the IT systems of Audi and logged and stored for the purpose of monitoring and ensuring the security of the Service for the fulfilment of the contract: ICCID of the mobile device, vehicle identification number (with which your vehicle can be uniquely identified and assigned to a specific owner), key status and authorisation status, changes of use (e.g. change of keys during the start of the vehicle, key activated / deactivated, feature activated / deactivated ) and time of use in case of changes and mileage.

d) Destination feed via myAudi portal or myAudi app or Google Maps™

With this Service, you can use your Audi ID and myAudi app and the mobile connection you use to transfer data stored in your Audi ID or mobile device (e.g. navigation destinations, contracts, calendar entries, settings, etc.) for the features of the Service to your vehicle via GoogleMaps™. If you have allowed access to these features, you may access addresses from your contacts or calendar entries with the corresponding calendar entries via the myAudi app, or access stored data from the myAudi system world and use it for navigation in the myAudi app or send it to your vehicle. For this Service, We process your Audi ID for the assignment of your myAudi account. Audi stores the data in the myAudi system world until you delete it in the myAudi portal or myAudi app or until you delete your Audi ID.

e) Vehicle status report

The Audi connect Service “Vehicle status report” allows you to view various vehicle data via the myAudi portal or the myAudi app.. As part of the Service, We process the following data or categories of data from your vehicle: the vehicle identification number (with which your vehicle can be uniquely identified and assigned to a specific owner) as well as the current status of the doors (locking status) and status of windows, hatches and, if applicable, convertible/sunroof, spoiler status, fuel and oil level, mileage, total range, parking light status, current warning messages, , data transmission time, and battery charge status for e-tron vehicles. The corresponding data are sent directly to our IT systems upon turning on or turning off the vehicle, locking and unlocking, when opening or closing doors as well as upon reaching the critical state of charge of the 12V battery or on your request by access in the myAudi potal or on your mobile device by the myAudi app, and is subsequently available for retrieval via the myAudi app and via the myAudi portal. In addition, your vehicle sends the position of your vehicle when the vehicle is turned off. The vehicle status is visible to every authorised user in the myAudi system world who has been activated by the primary user for this vehicle. We process the above data for the provision of the Audi connect Service in order to provide you and the authorised myAudi users with the information in the myAudi portal or myAudi app for retrieval. Only the last record sent by the vehicle is stored so that it can be displayed to you, and this is overwritten when a new record is sent.

f) Online Car Care

The Audi connect Service “Online Car Care” is a personalised Service, which means that the registration of an Audi ID is required for the use of the Service. As the primary user, you can choose to activate or deactivate this Audi connect Service in the myAudi portal and myAudi app.

1. With this Audi connect Service, Audi informs you of any recognised potential repair demand of your vehicle (so called “predictive information”). For this purpose your vehicle stores vehicle-related data during operation which provide an indication of any required future repair and transfers this data directly to the IT systems of Audi for evaluation purposes regarding the potential need for repair. You can review any recognised need for repair in the myAudi portal and myAudi app.

2. Additionally, Audi informs you by active indicator lights and drive notes in your vehicle (so called “Information on existing indicator lights and driver notes”). Your vehicle stores vehicle data during operation that provides information about the display of indicator lights and driver notes in the instrument cluster, and sends this data to the IT systems of Audi. After every journey, you can review active indicator lights and driver notes in the myAudi portal or myAudi app in addition to the instrument cluster. Audi will also inform you via the e-mail address linked to the Audi ID in case important indicator lights and driver notes remain active for a certain period of time or a certain distance driven.

3. This allows additionally for a quicker and more cost-efficient repair, as some of the data required for repair in the shop is already collected during operation. Your vehicle sends data about the vehicle condition or about the occurrence of a certain event (e.g. event memory entry) directly to the IT systems of Audi. Only the current record is stored. If your vehicle is repaired in the shop, the chosen Audi service partner may access this data record stored in the IT systems of Audi so that it does not need to be accessed on site in the shop which reduces the working hours in the shop (“quicker and more cost-efficient repair”).

4. In addition, your vehicle transfers certain vehicle-specific settings (e.g. setting for central locking of doors, comfort opening and closing of windows and sunroof, brightness values for lane change assistant, etc.) and information permanently stored in the vehicle (e.g. kilometres driven and time elapsed since the last service event for the service interval display, oil quality, etc.) which are collected during the operation of the vehicle directly to the IT systems of Audi. In case of repair, Audi service partners may also access this record stored in the IT systems of Audi. If an exchange of the control unit is necessary as part of the repair, the Audi service partner may transfer this data to the settings of the new control unit so that you do not have to re-adjust these settings (“backup of vehicle-specific settings and information”). There will be no other use of the data.

We process the following data, respectively categories of data from your vehicle for this Audi connect Service:

· the vehicle identification number (with which your vehicle can be uniquely identified and assigned to a specific owner), the time stamp of data collection and mileage (1.-4.)

· additional specific operational data in your vehicle (see chapter “Operational data in the vehicle”).

o This includes in 1.:

  • Operational data, which may provide an indication of future repair: vehicle status information, environmental conditions, operating states of system components, deviations from system states that lead to an event memory entry in the internal vehicle systems, reactions of the systems in special driving situations, state of charge of the high-voltage battery (for electric vehicles), estimated range, and information on the tuning status of various components (which can be used to determine whether your vehicle or parts thereof have been tuned).
  • Data transmission follows the principle of data minimisation, i.e. Audi evaluates all data collected for the calculation of predictions (“predictions”) of repairs. Your vehicle transfers this data at regular intervals (in some cases every time the vehicle is used) or when certain conditions are met (e.g. event memory entry, change in ambient or operating conditions, etc.).

o This includes in 2.:

  • Operating states of system components that provide information about the display of indicator lights and driver notes in the vehicle's instrument cluster.
  • Your vehicle transfers this data after the start and end of a journey in which an indicator lamp or driver information is active or its status changes to Audi.

o This includes in 3.:

  • Operating states of system components that provide information about the electronic structure state of the vehicle (e.g. active control units in the vehicle, control unit identification data, serial-, hardware- and software-numbers of control units, vehicle equipment data, etc.) as well as deviations from system states that lead to an event memory entry in the internal vehicle systems.
  • As a rule, your vehicle sends this data on a weekly basis or when a change in an operating status occurs that leads to an event memory entry in the vehicle to Audi. If the Audi connect Service is deactivated or terminated, the Audi service partner will have access to the last data sent prior the deactivation and can be used by the Audi service partner. For more information on processing this data, contact your Audi service partner.

o This includes in 4.:

  • Operating states of system components (e.g. oil wear level, time/distance until next service, privacy settings, personalised comfort settings of different accounts, etc.).
  • Your vehicle sends this data on a weekly basis to Audi. If the Audi connect Service is deactivated or terminated, the Audi service partner will have access to the last data sent prior the deactivation and can be used by the Audi service partner. For more information on processing this data, contact your Audi service partner.

In addition to the data from your vehicle, We process your name and e-mail address to inform you of important indicator lights and driver notes in accordance with no. 2. above. We process the aforementioned data for the provision of the Audi connect Service, to provide you and the authorised myAudi users the information in the myAudi portal or myAudi app.

g) Theft and tracking assistant

The Audi Connect Service “Theft and tracking assistant” is a personalised Service, i.e. the prerequisite for the use of the Service is the registration of an Audi ID. The primary user can configure the Service and activate or deactivate it in the myAudi portal or myAudi app. To activate the Service, We process the following data that you provide when you activate the Service in the myAudi portal or myAudi app: Registration: name and contact details (address, up to 3 mobile numbers) as well as information on the vehicle (colour, body type, license plate), vehicle identification number (with which your motor vehicle can be uniquely identified and assigned to a specific owner). This data is transferred to our service provider Vodafone Automotive Telematics SA, Via S. Franscini 10, 6850 Mendrisio, Switzerland or to a local service provider commissioned by the service provider to create the registration and activation. If the vehicle detects tampering, the vehicle sends the following data or categories of data to us and the service provider: tampering event, current vehicle position (location data, time and place), vehicle condition data (mileage, battery voltage, speed, fuelling level, time out of vehicle, ignition status, engine status). The vehicle then cyclically sends the current vehicle position. We transfer this data to our service provider. The service provider then contacts the contact information stored by the primary user in order to forward the alarm. With the consent of the primary user and upon confirmation of a theft or notification of a theft by the primary user, the service provider transmits the last known vehicle position to national security or investigation authorities. If the primary user reports a theft, the above data can also be actively queried from the vehicle via the service provider. We process the above data to provide the Audi connect Service to detect tampering events and to enable the localisation of your vehicle in case of theft. This Service can only be activated or deactivated by the primary user. It will not turn off when privacy settings are activated.

h) Audi service request online

To use the "Audi service request online" Audi connect service, you must use your personal Audi ID to activate the service on the myAudi portal or in the myAudi App. You can select your Audi service request online partner and store your personal contact data (name, telephone number, preferred communication by telephone or e-mail) for the desired service through the Audi service request online partner. When using the Audi service request online service, the following technical data required for an upcoming service for your vehicle is sent to Audi's IT systems:

  • Vehicle condition data (mileage, fuel tank level, oil filling level, etc.)
  • Service-relevant data (maintenance interval data, event log entries, warning indicators)
  • Vehicle master data

This data is merged with your contact data and transmitted to your chosen Audi service request online partner, where it is stored. Your Audi service request online partner uses this data for the purpose of preparing for an appointment, initiating contact and performing the specific services. Next, your Audi service request online partner will contact you for scheduling an appointment for this service by telephone or e-mail as indicated in your contact preferences. Audi uses your data to perform the service, then it uses anonymised data to optimise the service. Your data is not forwarded to third parties.

When your data is processed for the Audi service request online, your information may be accessed from the USA for the purposes of technical support. We have therefore concluded EU standard contractual clauses or SCCs (a set of contractual clauses approved by the European Commission that gives personal data the same protection as it has in the EU when data is processed in non-EU countries).

To activate the Audi connect service, for technical reasons you have to enter the data requested during service configuration, but there is no legal obligation for you to provide this data. You can view, change or delete your data at any time in the service configuration. However, deleting your data will deactivate the service.

i) Audi claims management

The “Audi claims management” Audi connect services places an automatic call to our call centre in the event of a minor accident. One click in the vehicle confirms the call. Alternatively, the service can also be used without Audi connect, via the telephone hotline. An Audi call centre employee will take your personal and accident information. To ensure fast and appropriate assistance and accident reporting, the call centre employee can access your Audi ID profile data. Your identity is found via your name and date of birth (if necessary, also via the phone number of the SIM card installed in the vehicle). The data is forwarded for further processing to the preferred dealer you have selected within myAudi (or a different dealer, whose details you provide to us on the phone).

You can use the service either by confirming a call from the vehicle or by actively calling the Audi call centre. If you do not actively confirm a call or make a call yourself, then no vehicle data is sent to the Audi call centre. We process the following data and categories of data as part of this service: Customer data (title, form of address, name, date of birth, address, country, telephone number, e-mail address, number plate), vehicle data (chassis number, brand, mileage, remaining range, model name, model year, colour, gearbox, type of drive, year of manufacture, vehicle type), insurance data (name of the insurance company of the accident reporter, insurance number of the accident reporter, type of damage, name of the other party's insurance company), damage details (impact zone, severity of impact, date of accident, time of accident, trigger, warning lights, DTC, GPS data, accuracy of GPS data, direction of travel, type of damage, date of damage assessment, ADAC membership).

We process the above data to provide the service so that we can provide rapid assistance in the event of an accident. The data will be passed on to your service partner for the purpose of providing service.

We pass on the data to third parties that you have selected in order for a contract with the third party to be performed or on the basis of your consent. Forwarding the data means that you can access the Audi connect service.

When your data is processed for Audi claims management online, it may be that your data is accessed from the USA for the purposes of technical support. We have therefore concluded EU standard contractual clauses or SCCs (a set of contractual clauses approved by the European Commission that gives personal data the same protection as it has in the EU when data is processed in non-EU countries).

We store your data for as long as is necessary to provide the Audi connect service to you or for as long as we have a legitimate interest in continuing to store the data.

3. Audi connect e-tron Services

The following online Services are available to you in Audi e-tron vehicles. Again, please note that not all listed Services may be available in your vehicle or country. For Audi A3 Sportback e-tron vehicles, entering the mileage in the myAudi portal or in the myAudi app is necessary to activate the following Services. In addition, the vehicle always transfers the mileage to Audi during the ignition process.

a) e-tron Charging Service

For the access to public charging stations, Audi offers the e-tron Charging Service to every user of an Audi e-tron vehicle. This service is provided by the cooperation partner Digital Charging Solutions GmbH, Brunnenstraße 19-21, 10119 Berlin, Deutschland / Germany , (“DCS”), which is the only controller for the processing activity. An Audi ID, the use of the myAudi portal or myAudi app and the conclusion of an agreement with DCS is required. Audi only transfers the technical ID of the Audi ID to DCS for the purpose of the provision of the Audi connect Service. Furthermore, we have no influence on the extent of the data that the cooperation partner DCS collects in connection with the conclusion of an agreement and your use of the service. The collection, processing, transmission and use of personal data, as well as the purpose of use is determined exclusively by the cooperation partner DCS. b) e-tron Charging System connect

1. As part of the e-tron Charging System connect service, we process the following data and categories of data from your vehicle and your e-tron Charging System connect:

  • Serial number to identify the charging system and associate the user
  • Device type for user information
  • Device status to display online status
  • Software version and date of update for user information
  • UserIDs to associate users to display the charging system in the user's myAudi account
  • Charging statistics to present the data as table and graph
  • Charging status to display charging status
  • Charging infrastructure information for the e-tron Charging System connect for user information
  • myAudi ID to identify the user

3. We process the above data in order to display the information about your e-tron Charging System connect in myAudi and to allow you to configure your e-tron Charging System connect, as well as to optimise the charging process to suit the preferences you set up in myAudi.

4./5. We use CarSoftwareOrg as hosting provider in connection with the Audi Charging System connect. The data is processed in the European Union.

6. We save the settings of your e-tron Charging System connect until you change them or delete the association between the charging system and your myAudi account. The information about the charging process is overwritten each time a new data record is sent, so that we only display the current status. Data regarding completed charges is continuously updated and displayed in table format in myAudi.

If you make use of the opportunity to use online Services of other providers (third parties), these Services are subject to the responsibility and the privacy and terms of use of the respective provider. We generally have no influence on the content exchanged here. Therefore, please obtain information on the nature, extent and purpose of the collection and use of personal data in the context of third-party Services by the respective service provider.

Data packages

This offer enables each user to purchase data packages for the use of the Wi-Fi hotspot from a partner mobile service provider of Audi and to use them in the linked vehicle. Prerequisite is the registration of a SIM owner with the mobile service provider. Audi will not transfer any personal data to the mobile service provider unless you have given your consent to such use or transmission. We have no control over the amount of data that the wireless service provider collects in connection with the purchase of the data package and your use of the offering. The collection, processing, transmission and use of personal data as well as the purpose are determined exclusively by the mobile service provider. D. Processing of personal data in joint controllership with Shop Operators (myAudi shop)

With regards to specific processing activities, Audi is a joint controller together with the respective operator of a myAudi Shop (see list of importers in Annex A, hereinafter “Shop Operator”), or with the Volkswagen Payments S.A. (19-21, Route d’Arlon, Bloc D, L-8009 Strassen, Luxembourg (hereinafter “Electronic Money Institution (EMI)”) as a payment service provider. Information on whether Audi is the only controller or a joint controller together with the Shop Operator or EMI for a certain processing activity can be found in the following sections. For further information on the processing of your payment data by EMI please use the following contact: DataProtectionVWFSLux@vwfs.com .

I. Which data do We process when using the myAudi shop?

We process the following categories of personal data which you provide when using the myAudi shop:

The following master data (in read mode) are used to enter the invoice address from the Audi ID:

· Master data and invoice data (salutation, surname, forename), date of birth

The invoice data includes the following mandatory data fields:

· Title (in Austria, Spain, Greece, United Kingdom, Ireland, Italy, Portugal, Canary Islands)

· Place of birth (in Italy)

· Phone and mobile phone number

· Invoice address (street, number, postal code, state (in United Kingdom, Ireland, Italy, Canary Islands), country

· Personal tax identification number (in Bulgary, Spain, Greece, Italy, Croatia, Spain)

· Person ID (in Bulgary)

The following information is voluntary:

· Title (in all markets except the markets listed under mandatory data fields)

  • Place of birth

Audi stores this data in your Audi ID and provides this data to the Shop Operator (participating affiliates according to Annex A) for your purchase in the myAudi shop. It is not possible to make a purchase without providing the mandatory data fields mentioned above. You can review this data in the Audi ID, respectively in the myAudi portal or myAudi app after a successful purchase. You have of course the opportunity to adjust the default data in the myAudi shop.

Your invoice data will be used as the default invoice address for additional purchases at the same myAudi shop or the myAudi shop of another Shop Operator. You have of course the opportunity to adjust the default invoice data except for the verified e-mail address in the myAudi shop.

You can provide the optional data for the invoice address at any later point in time, if this is required for a feature or Service. If additional data is necessary for the use of individual features in the myAudi portal or myAudi app, We will inform you in connection with the respective feature.

The e-mail address stored in your Audi ID is also the username for the log-in in the myAudi portal and myAudi app. It is used to unambiguously identify the user and can therefore not be changed or deleted in isolation. The change or deletion of the registered e-mail address requires the deletion of the entire Audi ID and creation of a new Audi ID using a different user name or e-mail address. When doing this you also need to again add your vehicle in the myAudi portal or myAudi app. Digital products and Services will continue to function even if the Audi ID is deleted or a new Audi ID is created as they are generally vehicle-related.

We are the joint Data Controllers with the Shop Operator when your basic data and invoice data are processed at the time that you make a purchase from the Shop Operator’s myAudi shop and for commercial mail from the Shop Operator. Audi therefore concluded an agreement with the respective Shop Operator in accordance with the legal requirements as to which data protection obligations are to be fulfilled by Audi and which by the Shop Operator. For more details on this internal distribution of responsibilities, please refer to the description in this section under D. VII. Irrespective of this agreement, you may assert your data protection rights described in section B. IV. both against Audi and against the Shop Operator.

II. Is there an obligation for me to provide data?

Providing the master data and invoice address data and other data for the registration with EMI described in section D. I. is required for the purchase in any myAudi shop. As part of our business relationship, you only need to provide the personal data that is required to enter into and conduct a business relationship, or that We are required to collect by law. Without this data, We will generally have to refuse to enter into the agreement or to execute the order, or will be unable to carry out an existing agreement and possibly have to terminate it. This means that the use of a Service or a feature requires that you provide the specified data. Unless you provide the data, We cannot provide the Service to you.

III. Processing of personal in joint controllership with Volkswagen Payments S.A. (hereinafter “Electronic Money Institution (EMI)”)

Due to technical reasons, any purchase in myAudi shops require that you are already registered with EMI.

When you make a purchase in a shop, We therefore collect the following categories of personal data (mandatory data field) in addition to the invoice data as described in section D. I:

  • Nationality

Audi stores this data in your Audi ID and transfers this data in addition to the master data described in section D. I. and the invoice address for the purposes of registration to EMI. You can review this data in the Audi ID as well as in the myAudi portal and myAudi app after the purchase. If you have stored your data in the myAudi portal or myAudi app, this data will be pre-filled for a future payment process in the same myAudi shop or in the myAudi shop of another Shop Operator (see list of participating affiliates in Annex A). However, you can of course adjust the pre-filled data in the myAudi shop. We will store the changes in your Audi ID and transfer them to EMI during the purchase.

In order to allow you to pay for goods and/or services in any myAudi shop, We implement a so-called plug-in from EMI, which allows you to transfer your payment data (for credit/debit cards: card number, expiry date, cardholder, card verification number - all information is mandatory) directly to EMI. We do not have access to the data transferred via the plug-in.

You can delete payment methods stored in the myAudi portal or the myAudi app at any time. You can review stored payment methods at any time in the profile settings for the myAudi portal, myAudi app, and myAudi shop.

Audi also processes your data for the following purposes: debtor management, address validation, risk management, sanctions list review, support and customer care. EMI and Audi are joint controllers for the collection and transmissions of your personal data for the purpose of registration with EMI. Audi therefore concluded an agreement with EMI in accordance with the legal requirements as to which data protection obligations are to be fulfilled by Audi and which by EMI. For more details on this internal distribution of responsibilities, please refer to the description in section D. VII. Irrespective of this agreement, you may assert your data protection rights described in section B. IV. both against Audi and against EMI.

IV. For which purposes and on which legal basis do We process your personal data?

Audi processes your personal data in connection with “myAudi shop” and “Electronic Money Institution (EMI)” on the following legal bases for the following purposes:

V. Who receives my data?

The customer gives his express consent and instructs EMI, domiciled in Luxembourg (Volkswagen Payments S.A.), to store the personal data relating to him (including in the case of legal entities company name, registered business address and registration number or in the case of natural persons name, address, date and place of birth, nationality and contact details) and the personal data of its beneficial owners and representatives as well as payment data (including means of payment, status of the wallet account ( Wallet-Konto) and payment orders) and usage data to Volkswagen Financial Services Digital Solutions GmbH, Contoworks GmbH, CRIF Bürgel GmbH, ACI Worldwide (Germany) GmbH, Concardis GmbH, Arvato Direct Services Potsdam GmbH and to all other recipients named in the privacy policy, including but not limited to those located in Germany and in other countries named in the privacy policy, or to make such data available to them. This data is transferred to or made available to the relevant service providers in connection with services provided for EMI under outsourcing agreements in order to provide high-quality and efficient services to the customer. In addition, the customer gives his consent and instructs EMI to transfer the personal data relating to him and the personal data of his beneficial owners and representatives and the data relating to the respective payment transactions to the intended beneficiary of these payment transactions (e.g. points of acceptance and marketplace operators), including the information that an instruction relating to an intended payment transaction was rejected. This transmission shall take place throughout the entire duration of the business relationship between EMI and the customer and for a period of three years after the termination of the business relationship.

The customer acknowledges that the data are no longer protected by Luxembourg professional secrecy after their transmission.

The customer gives his or her express consent and instructs the EMI to provide the providers of payment methods, including alternative means of payment used by customers or guest payers (Gast-Zahler), data for the identification of customers and guest payers (including in the case of legal entities company name, registered business address and registration number or in the case of natural persons name, address, date and place of birth, nationality and contact details) and personal data on its beneficial owners and representatives and, upon request of the providers of payment methods, including alternative means of payment, to provide data on payments, so that they can comply with their legal and regulatory obligations. The EMI shall transfer this data, upon the customer's instruction, to all companies involved in the processing of payment transactions commissioned by or on behalf of the customer.

For the purpose of sending largely standardized mail campaigns on behalf of the Shop Operator using Audi's IT systems, your personal data will be forwarded to a processor acting as a hosting provider in the USA.

VI. How long will my data be stored?

Audi stores your data as long as it is necessary for the provision of our Services to you or We have a legitimate interest in the further storage, in particular for reasons of troubleshooting.

In addition, We are subject to various retention and documentation obligations, which result, inter alia, from the German Commercial Code (HGB) and the German Tax Code (AO). The periods specified therefore for retention and documentation are up to ten years. Finally, the storage period is also assessed according to the statutory limitation periods, which can be up to thirty years, for example, according to Sections 195 et seqq. of the German Civil Code (Bürgerliches Gesetzbuch, BGB), with the regular period of limitation being three years.

Under certain circumstances, your data may also need to be retained for a longer period of time, such as when a so-called legal hold or litigation hold (i.e. a prohibition of data deletion for the duration of the proceedings) is ordered in connection with administrative or judicial proceedings.

However, you have the opportunity to delete your payment methods at any time in the myAudi portal or in the myAudi app. You can review your stored payment methods at any time in the profile settings of the myAudi portal, myAudi app or in the myAudi shop.
